The Department has recently revised its Solid Waste Regulation No. 8 (Composting Facilities) to include Small and Medium - Scale Composting Operations and Anaerobic Digestion Facility requirements. Due to the significant additions to the Regulation and the level of public interest in organics waste management, the Department decided to informally issue the draft Regulation in order to obtain feedback and suggestions from interested parties. With the new additions to Regulation Number 8, several definitions will be added to Solid Waste Number 1. At this time we are not releasing Reg. 1, but have included some of those definitions to facilitate review of the draft Regulation. Definitions to be included in Solid Waste Regulation Number 1 :
Small-scale Composting Operation – shall mean a composting operation that utilizes leaf, yard and putrescible waste and where no more than twenty-five (25) cubic yards of material, at any given time, exists on the property. This maximum quantity includes unincorporated feedstock and feedstock that has been placed into a composting process or a combination of the two materials. Finished compost is excluded from the maximum quantity of twenty-five (25) cubic yards.
Medium-scale Composting Operation – shall mean a composting operation registered by the Department that utilizes l eaf, yard and putrescible waste and where greater than twenty-five (25) cubic yards and no more than seventy-five (75) cubic yards of material, at any given time, exists on the property. This maximum quantity includes unincorporated feedstock and feedstock that has been placed into a composting process or a combination of the two materials. Finished compost is excluded from the maximum quantity of twenty-five (25) cubic yards.
Anaerobic Digestion Facility – shall mean a facility licensed by the Department that employs an anaerobic digester to decompose organic material.
